Article 53 is based on modern concepts of international relations and the rule of law, according to which States are not only subjects of international law but also legal subjects in each other’s national legal systems. Being a subject of national law, a State has the legal capacity to bear rights and duties, including the right to initiate an action in court to claim ownership of properties or compensation for damage.
